Guardianship Division NCAT's Guardianship Division makes decisions about people who have a decision making disability.  Appoints guardians & financial managers for people with disabilities & older people who are unable to make their own decisions. ​The Guardianship Division determines applications about adults ​who are incapable of making their own decisions and who may require a legally appointed substitute decision maker.

Applications to the Guardianship Division include:

  • Guardianship orders to appoint a ​​guardian to make personal or lifestyle decisions for someone with decision making disabilities.
  • Financial management orders to appoint a financial manager for someone who is not capable of managing their affairs.
  • Consent for treatment by a doctor or dentist. Review an enduring power of attorney.
  • Review an enduring guardianship appointment.


The Guardianship Tribunal of New South Wales, a former specialist disability tribunal of the Government of New South Wales for people with cognitive incapacity, or disability operated between 1989 and 2013. The Tribunal was superseded by the New South Wales Civil and Administrative Tribunal (NCAT) which came into effect from 1 January 2014. Its functions now operate within a divisional context in the NCAT.
